Terms of Service

1. Agreement to Terms

By accessing or using ANALIST at analist.digital (the "Service"), operated by Altai Digital ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms at any time, and your continued use of the Service constitutes acceptance of the updated Terms.

2. Definitions

• "Service" refers to the ANALIST social media analysis platform, including all features, tools, and APIs
• "User," "you," "your" refers to any individual or entity that accesses or uses the Service
• "Analysis" refers to the automated social media content analysis generated by our platform
• "Credits" refers to the virtual currency used to access analysis features on the platform
• "Content" refers to any data, text, analysis results, scripts, or other materials generated through the Service

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. We reserve the right to refuse service to anyone for any reason at any time.

4. Account Registration & Security

To access the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@analist.digital if you suspect unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.

5. Nature of Services

ANALIST provides AI-powered social media content analysis, including but not limited to viral content detection, video transcription, engagement analysis, and personalized content recommendations. The Service analyzes publicly available social media content only. We do not guarantee specific outcomes, engagement rates, follower growth, or business results from using our analyses and recommendations. All content suggestions and scripts are generated by AI and should be reviewed before use.

6. Free Analysis & Credits

6.1 Free Analysis (One Per Account)

Every new account receives exactly one (1) free analysisat no cost. This complimentary analysis is intended for you to evaluate the full capabilities of the Service before making any purchase. The free analysis includes the same features as a paid analysis — viral content detection, AI-generated scripts, engagement metrics, and personalized adaptations. The free analysis is:

• Limited to one per account — creating multiple accounts to obtain additional free analyses is a violation of these Terms and may result in account termination
• Non-transferable — cannot be gifted, sold, or moved to another account
• Permanent — does not expire; you may use it at any time after registration

6.2 Credit System

• After your free analysis, each subsequent analysis costs 200 credits
• Purchasing credits: Credits can be purchased through our platform. All payments are processed securely by Stripe; we do not store your payment card details
• Credit packs: Purchased credit packs do not expire

6.3 Subscriptions

• Subscription plans provide monthly credit allocations, granted upon payment and replenished at each billing cycle
• Subscription credits do not roll over to the next billing cycle unless otherwise stated in your specific plan
• You may cancel your subscription at any time; access continues until the end of the current billing period

6.4 Digital Service Consent & Right of Withdrawal

ANALIST is a digital service under EU Directive 2011/83/EU. By purchasing credits or a subscription and initiating an analysis, you expressly consent to the immediate performance of the service and acknowledge that you forfeit your 14-day right of withdrawal once the analysis has been delivered, in accordance with Article 16(m) of the Consumer Rights Directive. This consent is obtained at the point of purchase.

6.5 Refunds

For full details on refund eligibility, timelines, and how to request a refund, please refer to our Refund Policy. In summary: unused credits may be refunded within 14 days of purchase; used credits and delivered analyses are non-refundable; subscription cancellations take effect at the end of the billing period.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to access private, non-public social media accounts or data
• Use the Service to harass, stalk, or harm any individual
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scraping tools to access the Service beyond normal usage
• Resell, redistribute, or sublicense access to the Service or analysis results without our written consent
• Circumvent any access controls, rate limits, or security features
• Misrepresent your identity or affiliation with any person or entity
• Upload malicious code, viruses, or any harmful content

8. Intellectual Property

The Service, including its design, code, branding, logos, and documentation, is owned by Altai Digital and protected by intellectual property laws. You retain ownership of the company profile data you submit. Analysis results generated for your account are licensed to you for your internal business use. You may not claim ownership of the underlying AI models, algorithms, or platform technology. We reserve the right to use anonymized, aggregated data to improve our services.

9. User Content & Data

By submitting social media URLs or usernames for analysis, you represent that you have a legitimate business purpose for analyzing that publicly available content. You retain all rights to your company profile information. We process submitted data solely to provide the Service. You are responsible for ensuring that your use of analysis results complies with the terms of service of the respective social media platforms.

10. Third-Party Services

The Service integrates with third-party providers including Supabase, Stripe, Anthropic (Claude AI), Deepgram, and social media platform APIs. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of these integrations is also subject to their respective terms of service and privacy policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. ANALYSIS RESULTS ARE AI-GENERATED AND MAY CONTAIN INACCURACIES. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY ANALYSIS OR RECOMMENDATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTAI DIGITAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Altai Digital and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Any unused credits at the time of termination are forfeited and non-refundable. Sections that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation for a period of thirty (30) days. If the dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

16. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Altai Digital regarding the Service
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect
• Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent
• Force majeure: We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet service disruptions
